AN ORDINANCE OF THE CITY OF IRWINDALE, CALIFORNIA, AMENDING
CHAPTER 3.40, SECTION 3.40.030(B) OF THE IRWINDALE MUNICIPAL CODE
REGARDING CLAIM PREREQUISITES UNDER THE GOVERNMENT CLAIMS ACT
The CITY COUNCIL of the CITY of IRWINDALE, CALIFORNIA, does hereby
ordain as follows:
SECTION 1. Irwindale Municipal Code, at Section 3.40.030(B), entitled
"Procedures for claims and actions for money and damages arising out of tort and not
based upon contract", contained within Chapter 3.40, shall be amended to read as
follows, with the remainder of Chapter 3.40 remaining unmodified and in full force and
effect:
"3.40.030 Procedures for claims and actions for money and damages
arising out of tort and contract."
B. Contract and Other Claims -- Claim Prerequisites. No suit for money or
damages may be brought against the city on a cause of action for which this
section requires a claim to be presented until a written claim therefore has been
filed and acted upon in conformity with this section and Sections 945.4 and 945.6
of the Government code.
SECTION 2. If any section, subsection, subdivision, sentence, clause or phrase
of this Ordinance is for any reason held to be unconstitutional or otherwise invalid, such
invalidity shall not affect the validity of this entire Ordinance or any of the remaining
portions hereof. The City Council hereby declares that it would have passed this
Ordinance, and each section, subsection, subdivision, sentence, clause or phrase
hereof, irrespective of the fact that any one or more sections, subsections, subdivisions,
sees, clauses or phrases be declared unconstitutional or otherwise invalid.
SECTION 3. Except as expressly modified pursuant to this Ordinance, all
provisions of Chapter 3.40 of the Irwindale Municipal Code shall remain unmodified and
in full force and effect.
SECTION 4. This ordinance shall become effective 30 days from adoption.
SECTION 5. The Deputy City Clerk shall certify as to the passage and adoption
of this ordinance and shall cause the same to be posted at the designated locations in
the City of Irwindale.
