HomeMy WebLinkAbout633ORDINANCE NO. 633 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE AMENDING IRWINDALE MUNICIPAL CODE CHAPTER 2.26 TO ADOPT AND GRANT DESIGNATED LEVEL ONE STATUS TO QUALIFIED MEMBERS OF THE IRWINDALE POLICE DEPARTMENT RESERVE POLICE OFFICER UNIT, AS PER CALIFORNIA PENAL CODE SECTIONS 830.6(1)(2), 832.6(a)(1), AND 832.6(b) WHEREAS, the City of Irwindale does not currently have an ordinance by which Reserve Police Officers may be provided Designated Level I status; and WHEREAS, the California Commission on Peace Officers Standards and Training (P.O.S.T.) offers guidelines by which a reserve may be appointed to a `designated' level I position by authority of a city ordinance; and WHEREAS, the authority of a `designated' level I reserve, assigned to the prevention and detection of crime and the general enforcement of the laws of this state, shall include the full powers and duties of a peace officer as provided by Penal Code Section 830.1; and WHEREAS, the Irwindale Police Department Reserve Police Officer unit presently has three active reserve officers who meet the training requirements set forth by P.O.S.T. for this new position. NOW, THEREFORE, the City Council of the City of Irwindale, California, ordains as follows: SECTION 1. A new ordinance of the Irwindale Municipal Code is enacted under Title 2 Administration and Personnel, Chapter 2.26 entitled Police Reserve Officers to read as follows: "2.26 Police Reserve Officers 2.26.010 Level I reserves - Powers and duties - Statutory authority By statute, the Legislature has provided that police reserves who are rated as Level I reserves may be empowered by local governmental bodies to have those full peace officer powers and duties as provided by Penal Code Section 830.1. 2.26.020 Level I reserves- Eligibility determination Ordinance No. 633 Page 1 Those city police reserves who have qualified as Level I reserves pursuant to Penal Code Section 832.6(a)(1) or Penal Code Section 832.6(b) and, in addition, have completed a minimum of two years field experience comprising a minimum of 400 working hours with the Irwindale Police Department or as a lateral Level I Police Reserve Officer from another California P.O.S.T. agency, shall have those peace officer powers and duties as provided by Penal Code Section 830.1 in accordance with Penal Code Section 830.6(a)(2).11 SECTION 2. Except as expressly modified pursuant to this Ordinance, all other provisions of Title 2 of the Irwindale Municipal Code shall remain unmodified and in full force and effect. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published and/or posted at the designated locations in the City of Irwindale.
