AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF IRWINDALE AMENDING § 2.04.040 OF CHAPTER
2.04 OF TITLE 2 OF THE IRWINDALE MUNICIPAL
CODE PERTAINING TO SALARIES OF COUNCIL
MEMBERS.
A. Recitals.
(i) Section 605 of Article VI of the Charter of the
City of Irwindale provides that compensation for Members of the
City Council shall be established and may be modified, from time
to time, in accordance with the provisions of State law.
(ii) California Government Code § 36516 provides, in
pertinent part, as follows:
"(a) A city council may enact an ordinance
e" providing that each member of the city council shall
receive a salary, the amount of which shall be
determined by the following schedule:
"(1) In cities up to and including 35,000 in
population, up to and including three hundred dollars
($300.00) per month;...

"(c) Compensation of council members may be
increased beyond the amount provided in this section by
an ordinance or by an amendment to an ordinance but the
amount of the increase may not exceed an amount equal to
5 percent for each calendar year from the operative date
of the last adjustment of the salary in effect when the
ordinance or amendment is enacted..."
ON
(iii) California Government Code § 36516.5 provides as
follows:
"A change in compensation does not apply to a
councilman during his term of office; however, the
prohibition herein expressed shall not prevent the
adjustment of the compensation of all members of a
council serving staggered terms whenever one or more
members of such council becomes eligible for a salary
increase by virtue of his beginning a new term of
office."
(iv) The monthly salary for Members of the Irwindale
City Council now is fixed at $250.00 per month in accordance with
., Ordinance No. 385.
(v) It is the desire of the City Council to adjust the
salary of each Member of the City Council to reflect cost of
living adjustments in accordance with the above -referenced
provisions of the City's Charter and the California Government
Code.
B. Ordinance.
NOW, THEREFORE, the City Council of the City of
Irwindale does ordain as follows:
Section 1. Section 2.04.040 of Chapter 2.04 of Title 2
of the Irwindale Municipal Code hereby is amended to read, in
words and figures, as follows:

"Sec. 2.04.040. Council Members = Sala
Effective as of April 20 , 1994, the date of
commencement of the next term of office for certain
Members of the City Council, each Member of the City
Council shall receive a salary in the amount of Three
Hundred Eight -seven Dollars and Eight -two Cents
($387.82) per month."
Section 2. The City Clerk shall certify to the
adoption of this Ordinance and shall cause the same to be
published in the manner required by law.

Irwindale, do hereby certify that the foregoing Ordinance was
introduced at a regular meeting of the City Council of the City
of Irwindale held on the 24th day of January , 1994, and
was finally passed at a regular meeting of the City Council of
the City of Irwindale held on the 10th day of February
1994, by the following vote:
