AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF IRWINDALE AMENDING § 10.40.020 AND
§ 10.40.030 OF CHAPTER 10.40 OF TITLE 10 OF
THE IRWINDALE MUNICIPAL CODE PERTAINING TO
TRUCK ROUTES AND THE PROHIBITION OF DRIVING,
STANDING OR PARKING OF COMMERCIAL VEHICLES ON
CERTAIN CITY STREETS, RESPECTIVELY.
The City Council of the City of Irwindale does ordain
as follows:
Section 1. Section 10.40.020 of Chapter 10.40 of Title
10 of the Irwindale Municipal Code hereby is amended to read, in
words and figures, as follows:
u 10.40.020 Truck Routes - Sign Designation
Authority - Compliance Required - Streets Designated.
"A.Whenever this Code designates and describes
any street, or portion thereof, as a street the use of
which is permitted by any vehicle exceeding a maximum
gross weight of three (3) tons, the City Traffic
Engineer is authorized to designate such street or
portion by appropriate signs as truck traffic routes for
movement of vehicles exceeding a maximum gross weight of
three (3) tons.
"B.When any such truck traffic route or routes
are established and designated by appropriate signs, no
person shall drive, stand or park any vehicle exceeding
a maximum gross weight of three (3) tons on any street,
or portion of a street, except those so designated as
truck traffic routes; provided, however, that this

section shall not prohibit the uses set forth in § 35703
and § 35704 of the California Vehicle Code. The
provisions of this section shall not apply to passenger
buses under the jurisdiction of the Public Utilities
Commission.
"C. The following streets and parts of streets are
declared to be truck traffic routes for the movement of
vehicles exceeding a maximum gross weight of three tons:
Arrow Highway Los Angeles Street
Azusa Canyon Road Lower Azusa Road
Buena Vista Street Myrtle Avenue
Cypress Street Peck Road
Foothill Boulevard Rivergrade Road
Irwindale Avenue Stewart Avenue
Live Oak Avenue Vincent Avenue
Longden Avenue
"D. A violation of this Section shall constitute
an infraction and shall be punishable as provided in
this Code."
Section 2. Section 10.40.030 of Chapter 10.40 of Title
10 of the Irwindale Municipal Code hereby is amended to read, in
words and figures, as follows:
"10.40.Q10 _Commercial- -Wehiclas—Prohibited—Prom
Using Certain Streets.
"A. Whenever this Code designates and describes
any street, or portion thereof, as a street the use of

which is prohibited by commercial vehicles exceeding a
maximum weight of three (3) tons, the City Traffic
Engineer shall erect and maintain appropriate signs on
the streets, or portions thereof, affected thereby.
"B. The following streets, or portions thereof,
hereby are declared to be streets the use of which is
prohibited for driving, standing or parking by any
commercial vehicle exceeding a maximum gross weight of
three (3) tons:
Allen Drive Martinez Street
Ayon Avenue Morada Street
Baca Avenue Nora Avenue
Calle Del Norte Olive Street
Calle Del Paseo Park Avenue
Calle Del Sur Park Rose Avenue
Central Street Par4ue Del Norte
Fraijo Avenue Pepper Tree Lane
Hidalgo Street Progress Lane
Huston Street Ruelas Street
Juarez Street Sabre Lane
"C. Notwithstanding the provisions of subsections
A and B above, the provisions thereof shall not prohibit
the use of said streets by commercial vehicles for-the-
uses specified in § 35703 and § 35704 of the California
Vehicle Code.

"D. A violation of this Section shall constitute
an infraction and shall be punishable as provided in
this Code."
Section 3. Civil Remedies Available.
A violation of any of the provisions of this Ordinance
shall constitute a nuisance and may be abated by the City through
civil process by means of restraining order, preliminary or
permanent injunction, or in any other manner provided by law for
the abatement of such nuisance.
Section 4. Penalties for Violation of Ordinance.
It shall be unlawful for any person to violate any
provision, or fail to comply with any of the requirements of this
Ordinance. Any person violating any provision of this Ordinance
or failing to comply with any of its requirements shall be deemed
guilty of an infraction and upon conviction thereof shall be
punished by (a) a fine not exceeding One Hundred Dollars
($100.00) for a first violation; (b) a fine not exceeding Two
Hundred Dollars ($200.00) for a second violation within one (1)
year; (c) a fine not exceeding Five Hundred Dollars ($500.00) for
each additional violation within one (1) year.
Section 5. Severability.
The City Council declares that, should any provision,
section, paragraph, sentence or word_of this_ Ordinance be
rendered or declared invalid by any final court action in a court
of competent jurisdiction, or by reason of any preemptive
legislation, the remaining provisions, sections, paragraphs,

sentences and words of this Ordinance shall remain in full force
and effect.
Section 6. The City Clerk shall certify to the
adoption of this Ordinance and shall cause the same to be
published as required by law.
ADOPTED AND APPROVED this 28th day of August
1995.

introduced at a regular meeting of the Council of the City of
Irwindale held on the 24th day of July , 1995, and
was finally passed at a regular meeting of the Council of the
City of Irwindale held on the 28th day of August
1995 by the following vote:
