HomeMy WebLinkAbout663ORDINANCE NO. 663 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE ADDING CHAPTER 17.14 TO THE CITY OF IRWINDALE MUNICIPAL CODE, REGARDING THE OPEN SPACE ZONE, WHICH WILL AFFECT PROPERTIES CITYWIDE WHEREAS, the City of Irwindale, 5050 North Irwindale Avenue, Irwindale, CA 91706, the Applicant, has made a request for a Zone Ordinance Amendment (ZOA 3- 12) to the Irwindale Municipal Code regarding establishment of an Open Space (OS) zone, which will affect properties Citywide, to initiate a change to the code; and WHEREAS, on September 19, 2012, the Planning Commission conducted a duly noticed public hearing, as required by law, on the Application and recommended that the City Council approve the Zone Ordinance Amendment, subject to the approval of an ordinance; and WHEREAS, on October 24, 2012, the City Council conducted a duly noticed public hearing, as required by law, on the Application and recommendation of the Planning Commission to approve this Zone Ordinance Amendment which would establish an Open Space zone which provides zoning standards and requirements to regulate open space areas in the City that are consistent with the Open Space/Easements land use that is designated by the General Plan. The City Council took testimony and reviewed relevant documentary evidence and conducted a first reading of the Zone Ordinance Amendment. WHEREAS, all legal prerequisites to the adoption of this Ordinance have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council finds that the above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Council authorizes the addition of Chapter 17.14, entitled "0-S Open Space Zone" to read as follows: Chapter 17.14 0-S OPEN SPACE ZONE 17.14.010 Purpose. 17.14.020 Permitted Uses. 17.14.030 Uses Requiring a Conditional Use Permit. Ordinance No. 663 Page 1 17.14.040 Prohibited Uses. 17.14.050 Standards of Development. 17.14.010 Purpose. The OS Open Space Zone provides zoning standards and requirements to regulate open space areas in the City that are consistent with the Open Space/Easements land use that is designated by the General Plan. 17.14.020 Permitted Uses. The following uses are permitted in the OS Zone: A. Eating and Drinking Establishments if incidental to recreational facility. B. Public Buildings and Facilities, such as libraries, governmental buildings, and police and fire stations. C. Transmission Lines, Towers, Poles, Pipelines, and Underground Facilities For gas, water, electricity, telephone or telegraph service owned and operated by a public utility company under the jurisdiction of the California Public Utilities Commission. D. Utility Easements. E. Parks. F. Open Space. 17.14.030 Uses Requiring a Conditional Use Permit. The following uses require a Conditional Use Permit: A. Cemeteries. B. Heliports. C. Electric Transmission Substations, Electric Distribution Stations, Communications Equipment Buildings, Microwave Radio and Telephone Transmission Facilities used in the operation of public utility functions, and/or easements. D. Flood Control Areas and Facilities, including flood control channels, spreading grounds and settling basins. E. Microwave Relay Stations. F. Special Districts, including park districts, lighting and landscaping districts, Ordinance No. 663 Page 2 improvement districts, and open space maintenance districts; and other dedications for public ownership. These districts could be used for landscaping, maintenance of flood control facilities, lighting, and other local improvements. G. Radio, Television, or Commercial Communications Transmitter, Receiver, or Translator. H. Water Wells, Reservoirs, Tanks, Dams, Treatment Plants, Gauging Stations, Pumping Stations and any use normal and appurtenant to the obtainment, storage or distribution of water. Wireless Communications Facilities. J. Golf Courses K. Recreational Facilities — Public and Not-for-Profit 17.14.050 Standards of Development. A. There are no minimum standards relating to lot area, lot width, lot depth, or lot coverage for any OS zoned area. B. Building Height: Any building or structure shall not exceed two stories or 30 feet in height, whichever is less. C. Setbacks: The following setback standards shall apply. Depending upon the type of use proposed and adjacent land uses, the Community Development Director will have administrative discretion to reduce these setbacks, provided additional landscaping or other amenities are provided. 1. Front setback that abuts a public street: 20 feet. 2. Rear and side setbacks that abut a residential zone: 50 feet. 3. Rear and side setbacks that abut a non-residential zone: 20 feet. SECTION 3. The City Council hereby authorizes and directs the Mayor and the City Clerk to execute this Ordinance on behalf of the City of Irwindale forthwith upon its adoption. The Deputy City Clerk shall certify as to the passage of this Ordinance and shall cause the same to be published and/or posted at the designated locations in the City of Irwindale. SECTION 5. City staff is directed to prepare and file a Notice of Exemption under the California Environmental and Quality Act (CEQA) in connection with this project.
