HomeMy WebLinkAbout676ORDINANCE NO. 676 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE CREATING A NEW ZONING DESIGNATION (AUTOMOBILE DISMANTLING PLANNED DEVELOPMENT OVERLAY ZONE) ON PROPERTY LOCATED ALONG ALPHA STREET (700 — 800 ADDRESS RANGE), MAKING FINDINGS IN SUPPORT THEREOF, AND FILING OF A NOTICE OF EXEMPTION PURSUANT TO CALIFORNIA ENVIRONMENTAL QUALITY ACT GUIDELINES SECTION 15061(B)(3) WHEREAS, the City of Irwindale, 5050 Irwindale Avenue, Irwindale, CA 91706, the Applicant, has initiated a Zone Change (ZC No. 02-2013) for the creation of a Planned Development Overlay zone that will be used to specifically address automobile dismantling uses and their incidental operations. The Zone Change only pertains to the 700-800 block of Alpha Street, which is currently zoned M-2 (Heavy Manufacturing), and contains existing automobile dismantling uses and their incidental operations; and WHEREAS, this Zone Change is being processed concurrently with Zoning Ordinance Amendment No. 06-2013, which amends Irwindale Municipal Code Chapters 5.12, 17.08, 17.56, and 17.64, and adds Chapter 17.100 regarding the creation of the Automobile Dismantling Planned Development Overlay Zone; and. WHEREAS, the underlying base zone will remain M-2 (Heavy Manufacturing). Properties within the overlay will continue to be subject to the requirements of both the overlay and base zoning designations; and WHEREAS, on March 19, 2014, the Planning Commission conducted a duly noticed public hearing, as required by law, on the Application and recommended that the City Council approve the Zone Change, subject to the approval of an ordinance, which would detail the specific conditions under which such portion of the Application was approved; and WHEREAS, on April 23, 2014, the City Council conducted a duly noticed public hearing, as required by law, on the Application and recommendation of the Planning Commission to approve this Zone Change creating a new zoning designation for automobile dismantling uses, took testimony and reviewed relevant documentary evidence; and WHEREAS, all legal prerequisites to the adoption of this Ordinance have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council finds that the above recitals are true and correct and are incorporated herein by this reference. City Council Ordinance No. 676 Page 1 of 3 SECTION 2. The City's Zoning Map is hereby amended, adding the Automobile Dismantling Planned Development Overlay Zone. The underlying base zone will remain M-2 (Heavy Manufacturing). Properties within the overlay zone will continue to be subject to the requirements of both the overlay and base zoning designations. SECTION 3. The City Council hereby authorizes and directs the Mayor and the Deputy City Clerk to execute this Ordinance on behalf of the City of Irwindale forthwith upon its adoption. SECTION 4. The Deputy City Clerk shall certify as to the passage of this Ordinance and shall cause the same to be published and/or posted at the designated locations in the City of Irwindale. SECTION 5. Upon the effective date of this ordinance, Urgency Ordinance No. 670, extending the moratorium on temporarily prohibiting the establishment of new automotive dismantling uses and prohibiting the extension, modification or intensification of existing automotive dismantling uses, shall terminate and be of no further force or effect. SECTION 6. City staff is directed to prepare and file a Notice of Exemption under the California Environmental and Quality Act (CEQA) in connection with this project.
