HomeMy WebLinkAbout741ORDINANCE NO. 741 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF IRWINDALE, CALIFORNIA, ADOPTING THE PARK @ LIVE OAK SPECIFIC PLAN (ZOA 01-2019) DEFINING PERMITTED USES, REGULATING THE SIZES AND LOCATIONS OF BUILDINGS, SPECIFYING DESIGN GUIDELINES AND DEVELOPMENT STANDARDS, IDENTIFYING PROJECT INFRASTRUCTURE AND SERVICES, AND PROVIDING ADMINISTRATIVE AND IMPLEMENTATION LANGUAGE, FOR PROPERTY LOCATED AT 1200, 1220, AND 1270 ARROW HIGHWAY, IRWINDALE, CA (APNs: 8532-001-002, 8532-001-006 and 8532-001-007) WHEREAS, Tony Spinrad, on behalf of Irwindale Partners II, LLC, 510 East Foothill Boulevard, Suite 206, San Dimas, CA 91711, the Applicant, has made a request for a Zone Ordinance Amendment (ZOA) to amend the Community Development Element and Land Use Plan Map from Regional Commercial to The Park @ Live Oak Specific Plan for property located at 1200, 1220, and 1270 Arrow Highway — APN's: 8532-001-002, 8532-001-006, 8532-001-007. (This ZOA is being processed concurrently with Zone Change No. 01-2017, General Plan Amendment No. 01-2017, Development Agreement No. 01-2017, Tentative Parcel Map No. 82551 and FEIR State Clearinghouse No. SCH# 2018041001); and WHEREAS, Government Code Section 65450 et seq. provides a process for preparing, processing, reviewing, adopting, and amending specific plans; and WHEREAS, the Applicant has proposed The Park @ Live Oak Specific Plan ("SP'), which provides, inter alia, for the planned use and long-term development of the site for next 10+ years; and WHEREAS, the project location for the SP is located at 1200, 1220, and 1270 Arrow Highway (APN's: 8532-001-002, 8532-001-006 and 8532-001-007); and WHEREAS, the City of Irwindale is the Lead Agency for the SP project pursuant to CEQA; and WHEREAS, pursuant to the authority and criteria contained in the CEQA of 1970, as amended, and the City of Irwindale environmental guidelines, the City of Irwindale, as the Lead Agency, has analyzed the project and has considered the Final Environmental Impact Report ("FEIR") prepared for the SP project. A copy of the FEIR was circulated through the State Clearinghouse (SCH# 2018041001), posted on the City's website, and was available at the Irwindale Public Library and City Clerk's Office. A copy of the FEIR and Mitigation Monitoring and Reporting Program was posted on the City's website; and WHEREAS, the FEIR for the environmental impacts, alternatives, an Live Oak Specific Plan, and has bees Resources Code Section 21000 et sec California Code of Regulations, Section proposed SP provides an assessment of the I mitigation measures associated with the Park @ prepared in accordance with the CEQA, Public (CEQA), and State regulations in Title 14 of the 15000 et seq. (CEQA Guidelines); and Ordinance No. 741 Page 1 WHEREAS, on December 18, 2019, the Planning Commission held a duly noticed public hearing on the proposed SP (Zone Ordinance (ZOA No. 0-2019)), at which time oral and documentary evidence was introduced, along with the written recommendation of the City of Irwindale Planning Commission, received public testimony and unanimously adopted Resolution No. 776(19) recommending that the City Council approve ZOA No. 01- 2019; and WHEREAS, notice of a public hearing before the City Council on the proposed SP adoption, was given in accordance with applicable law; and WHEREAS, on February 12, 2020 Irwindale City Council conducted a duly noticed public hearing, as required by law, on the Park @ Live Oak Specific Plan project and Final EIR; and WHEREAS, a copy of the proposed SP as presented to the City Council is on file with the Community Development Department, at City Hall, additional printed copies are also posted at the Irwindale Public Library, and an electronic copy is provided on the City's website; and WHEREAS, the City Council has considered the staff report and all of the information, evidence, and testimony received at the public hearing; and WHEREAS, On February 26, 2020, the City Council duly approved and adopted on second reading, Ordinance No. 741; and WHEREAS, all legal prerequisites to the adoption of this Ordinance have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The Recitals above are true and correct and incorporated herein by the reference. Section 2. Based upon substantial evidence presented to the City Council during the public hearing, including written staff reports and verbal testimony, the City Council hereby finds and determines: The proposed SP is in the best interest and welfare of the City and its residents. The proposed SP provides a comprehensive framework for the long- term growth and development of the entire business park, provides clarity in processes and in the coordination between the applicant, developers, and City. 1. The proposed SP is consistent with the City's General Plan. The Community Development Element of the General Plan promotes several policies that support the adoption of the SP and associated entitlements. Community Development Element Policy 1 strives to preserve the overall mix of land uses and development in the community. Community Development Element Policy 3 seeks to ensure that the type, location, and intensity of all new development and intensified developments adhere to the requirements specified in its particular Ordinance No. 741 Page 2 land use category. Community Development Element Policy 5 promotes the comprehensive development consistent with the General Plan as opposed to piecemeal and incremental planning. If adopted, proposed The Park @ Live Oak Specific Plan, which implements policies set forth in the General Plan, would provide standards and guidelines for the development of the business park over several years, addresses sustainable practices on and off-site, promotes compatibility with surrounding areas, and provides a unique and flexible policy document that facilitates orderly development of the site. 2. The SP and the adoption thereof complies with Government Code Section 65450 et seq. Section 3. Based upon the substantial evidence and testimony received at the public hearing and the findings and conclusions set forth hereinabove, the City Council hereby accepts the recommendation of the Planning Commission and hereby adopts The Park @ Live Oak Specific Plan, on file with the Community Development Department and as presented to the City Council at the time of the adoption of this Ordinance. Section 4. If any section, subsection, subdivision, paragraph, sentence, clause or phrase, or portion of this Ordinance is, for any reason, held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction , such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The City Council herby declares that it would have adopted this Ordinance and each section, subsection, subdivision, paragraph , sentence, clause or phrase of this Ordinance irrespective of the fact that one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared unconstitutional or invalid or ineffective. To this end, the provisions of this Ordinance are declared severable. Section 5. This Ordinance shall take effect thirty (30) days after its adoption. The City Council hereby authorizes and directs the Mayor and the Chief Deputy City Clerk to execute this Ordinance on behalf of the City of Irwindale forthwith upon its adoption. Section 6. The Chief Deputy City Clerk shall certify as to the passage of this Ordinance and shall cause the same to be published and/or posted at the designated locations in the City of Irwindale.
