AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF IRWINDALE TEMPORARILY SUSPENDING THE ANNUAL ADJUSTMENT
OF RATES BASED ON THE CONSUMER PRICE INDEX (CPI) FOR BUSINESS
LICENSE FEES AND AUTHORIZE A 90 -DAY DEFERMENT ON BUSINESS LICENSE
FEES UNDER SECTIONS 5.08.490 AND 5.08.500, RESPECTIVELY, OF THE
IRWINDALE MUNICIPAL CODE TO OFFSET THE ECONOMIC IMPACT ON
BUSINESSES IN THE CITY OF IRWINDALE AS A RESULT OF THE COVID-19
PANDEMIC.
WHEREAS, Irwindale adopted the license fees and taxes ordinance, as codified
under Chapter 5.08 of the Irwindale Municipal Code, including imposing an annual
adjustment of rates based upon the percentage change for the prior calendar year in the
California Consumer Price Index under Section 5.08.490 for every business doing
business in within the city including those computed on gross receipts, flat rate, mining
or excavation, depletion, dumping or any other basis; and
WHEREAS, Section 5.08.500 of the Irwindale Municipal Code sets payment
dates on all licenses shall be paid on the first of July of each year, and the delinquency
of payments shall apply from such date; and
WHEREAS, business license fee adjustments have been made every year based
on the Consumer Price Index since the establishment of Ordinance No. 275; and
WHEREAS, the COVID-19 pandemic has caused unexpected financial hardships
on local business establishments resulting in the closure of many businesses;
WHEREAS, to support local businesses in this economic downturn, the City
Council wishes to temporarily suspend the annual rate adjustment applicable to
business license and other fees subject to adjustment to Section 5.08.490, but not
including any voter -approved taxes, of 0.7% for fiscal year 2020-2021 as a business
friendly effort;
WHEREAS, the one-time suspension of the annual adjustment applicable to
business license fees and other fees will result in an estimated revenue loss of $9,600
for FY 2020-2021;
WHEREAS, the City Council also wishes to authorize a 90 -day deferment on
business license tax fees due by July 1, 2020.
THE CITY COUNCIL OF THE CITY OF IRWINDALE DOES HEREBY ORDAIN
AS FOLLOWS:

SECTION 1. The City Council of the City of Irwindale finds that the above
recitals are true and correct.
SECTION 2. The City Council finds that a temporary suspension of the annual
rate adjustment of 0.7% is a reasonable means of supporting Irwindale businesses
affected by the economic downturn caused by the COVID-19 pandemic and that
provided such support serves a valid public purpose. As such, all fees pursuant to
Irwindale Municipal Code Chapter 5.08, but excluding any voter -approved taxes, such
as mining taxes and other taxes, shall not include any increase pursuant to the
Consumer Price Index, as required under Section 5.08.490, for the 2020-2021 fiscal
year. Thereafter, commencing on July 1, 2021, increases required under Section
5.08.490 shall resume. As a temporary reduction of applicable fees, no further action or
compliance with Proposition 218 or any other procedural or substantive requirement for
adoption or increase of fees shall apply upon the termination of this temporary
reduction.
SECTION 3. The City Council finds that authorizing a 90 -day deferment on
payments due by July 1, 2020, as required by Irwindale Municipal Code section
5.08.500, will assist businesses facing financial hardships, thus improving the survival
odds for businesses in the City, and that provided such assistance serves a valid public
purpose. As such, all payments of business license fees required per Irwindale
Municipal Code section 5.08.500 shall be made by September 30, 2020.
SECTION 4. This ordinance shall take effect immediately pursuant to
Government Code Section 36937(d).
SECTION 5. The Chief Deputy City Clerk shall certify as to the passage and
adoption of this ordinance and shall cause the same to be posted at the designated
locations in the City of Irwindale.
